1. Introduction
1.1 Inspectedge, operated by Inspectedge Private Limited (“we”, “our”, “Company”), provides property, building, and facility inspection and assessment services to homeowners, Resident Welfare Associations (RWAs), developers, and businesses (collectively, the “Services”).
1.2 These Terms of Use (“Terms”) govern how you use our website inspectedge.com (the “Platform”) and our Services. By using the Platform or Services, you agree to these Terms.
- Company Content: materials on the Platform, including text, images, videos, and designs owned or licensed by us.
- Force Majeure: events beyond our reasonable control such as natural disasters, pandemics, strikes, government orders, or cyberattacks.
- User: any person, RWA, builder, or business using our Platform or Services, including clients who sign a Proposal.
2. Access and Use
2.1 You may only use our Platform and Services in compliance with these Terms and applicable law. If you do not agree, please stop using them.
2.2 Once you accept these Terms (and any Proposal or policies), we will use reasonable efforts to deliver the Services.
2.3 The Services provided depend on your agreement with us. We may modify or discontinue Services without prior notice.
3. Company Rights
All intellectual property in our Platform, Services, and Company Content belongs to us or our licensors. Using our Services does not give you any ownership or rights in this material.
4. User Responsibilities
You are responsible for the content you upload, post, or send to us. By sharing content, you grant us a license to use, copy, and share it in connection with the Services. You must not upload unlawful, harmful, or malicious material.
5. Use of Platform & Services
- Use the Platform only for lawful purposes and as permitted by these Terms or any Proposal.
- We are not responsible for third-party websites or tools linked through the Platform.
- Any use of third-party tools available via the Platform is at your own risk.
6. Limitations, Liability & Indemnity
You agree to indemnify and hold harmless Inspectedge and its representatives from claims or damages arising from your use of the Platform or Services.
Our Services are provided “as is,” without warranties. Inspections are visual, non-invasive checks only and do not guarantee against hidden or future defects.
If we make a material error, our liability is limited to re-performing the inspection or refunding a proportional part of the fees, if notified within 7 days. In no event shall our liability exceed 50% of fees paid, or INR 500 if Services were free.
7. Representations
- You confirm you are legally capable of entering into this agreement.
- If using Services on behalf of an organization, you confirm you are authorized to bind it to these Terms.
8. Termination
These Terms apply until you stop using the Platform or we suspend/terminate access. We may terminate access if you breach these Terms or as required by law. Any obligations (such as payments) arising before termination will continue.
9. Communications
By using the Platform, you consent to electronic communications from us. We may send service updates and marketing (where legally allowed). Feedback you provide may be used freely to improve our Services.
10. Other Terms
- Assignment: We may transfer our rights or obligations; you may not without our written consent.
- Force Majeure: We are not liable for delays caused by events outside our control.
- Governing Law: These Terms are governed by Indian law, with disputes resolved by arbitration in Hyderabad, India, in English.
- Brand Use: With your consent, we may use your name, logo, or testimonial in marketing materials.
- Conflict: If these Terms conflict with a Proposal, the Proposal prevails.
